Mr. Yeoh Tze Hwa (Andy) is a founding partner of Messrs Yeoh Shim Siow & Lay Kuan, where he leads the firm’s dispute resolution and intellectual property (IP) practice.

Andy’s legal career is defined by his versatility and depth across a wide spectrum of civil litigation. His practice spans general civil litigation, corporate and commercial disputes, judicial review, insurance and reinsurance, construction law, employment and industrial relations, family and matrimonial disputes, land and real estate (including strata title and compulsory acquisitions), tortious claims, contentious probate and estate matters, and tenancy disputes. He has acted for individuals, SMEs, multinational corporations, NGOs, and government-linked entities in complex disputes that often involve high financial stakes or regulatory sensitivities.

In the realm of intellectual property, Andy is recognised as a seasoned litigator and strategic advisor, with considerable experience managing IP portfolios and enforcing rights through litigation and commercial channels. He routinely handles high-stakes disputes involving patents, trademarks, copyrights, trade secrets, industrial designs, domain names, and passing off, both at the trial and appellate levels. His litigation practice includes obtaining injunctive relief, Anton Piller orders, and interlocutory restraining orders to prevent further infringement or dissipation of IP assets. He has argued and succeeded in IP disputes before the High Court, Court of Appeal, and Federal Court of Malaysia.

Beyond the courtroom, Andy’s IP practice extends to strategic advisory and transactional work, where he assists clients with brand protection, IP commercialisation, licensing agreements, franchise structuring, and cross-border IP enforcement. He has advised and acted for a wide range of industries—including technology, pharmaceuticals, software, digital media, FMCG, manufacturing, education, and fashion—across jurisdictions, offering nuanced counsel tailored to commercial and regulatory realities in Malaysia and the ASEAN region.

Andy is also active in multi-jurisdictional IP enforcement efforts, including border seizures, domain name takedown actions, and coordination with overseas counsel for concurrent foreign proceedings. His understanding of regional legal frameworks enables clients to navigate overlapping regulatory regimes and international treaties with confidence.

Clients frequently turn to Andy for pre-transactional risk analysis in construction and commercial projects, leveraging his deep litigation background to anticipate and mitigate downstream legal exposure. His ability to “litigate backwards”—anticipating how contracts will be interpreted and enforced in court—adds critical value during contract drafting, negotiations, and project structuring.

Andy has argued numerous reported cases across different areas of law and has achieved success at all tiers of the Malaysian court system, including the Federal Court, demonstrating both appellate skill and trial advocacy strength. Prior to co-founding Messrs Yeoh Shim Siow & Lay Kuan, Andy was a partner in the dispute resolution department of Messrs Ismail Sabri Wee & Wong, where he honed his courtroom craft and managed large-scale litigation files from early case strategy to final appeal.

  • Acted for the Plaintiff in a high-value software copyright infringement suit in Flexsoft Technology Sdn Bhd v First E-Formatics Sdn Bhd & Ors [2020] 1 LNS 253, involving unauthorised use of enterprise-level software modules.
  • Regularly advises on IP enforcement, brand protection, licensing, and commercial exploitation of IP assets, covering patents, trademarks, copyrights, trade secrets, and industrial designs.

  • Successfully acted for the Plaintiff in Mobile One Stop Supply Sdn Bhd v Au Yee Chen & Ors [2025] MLJU 1202, a full trial involving breach of fiduciary duty by former employees and misappropriation of company resources. The Court ruled in favour of the Plaintiff and dismissed the counterclaim for unlawful dismissal.
  • Successfully resisted a striking-out application in Mobile One Stop Supply Sdn Bhd v Au Yee Chen & Ors (No. 2) [2025] MLJU 1459, where the High Court affirmed the Plaintiff’s cause of action based on breach of fiduciary duties and allowed the matter to proceed to trial.
  • Regularly acts in employment litigation, including wrongful dismissal claims and injunctive relief against dissipation of company property.

  • Acted for homebuyers in a landmark Court of Appeal case on Liquidated Ascertained Damages (LAD), successfully arguing that LAD should be calculated from the date of booking fees rather than the sale and purchase agreement (SPA).
  • Represented a group of owners in a strata title class action involving The Summit USJ, where the Strata Tribunal ruled that the Management Corporation’s unilateral conversion of common areas was illegal.

  • Acted for over sixty organisations in Rumah Amal Cheshire Selangor & Ors v Dewan Bandaraya Kuala Lumpur & Ors [2018] 1 LNS 968, successfully challenging the construction of a chicken slaughterhouse near residential and welfare premises.
  • Represented Sri Ternak Mart (SK) Sdn Bhd in a judicial review against Majlis Perbandaran Subang Jaya [2019] 1 LNS 1256, where the Court confirmed that movable property not affixed to a building is compensable under Section 72 of the Street, Drainage and Building Act 1974.

  • Acted for the Defendant in LB Land Sdn Bhd v Ho Nyet Foong [2024] MLJU 2019, where the Plaintiff sought an injunction to restrain durian orchard activities. The High Court granted an interlocutory injunction limiting the Defendant’s farming activities.
  • Successfully appealed to the Court of Appeal, which set aside the High Court’s injunction, affirming landowner rights and reiterating strict legal thresholds for environmental nuisance claims. The case involved balancing property development interests against longstanding agricultural use.

  • Acted for a mother in obtaining an urgent injunction to prevent dissipation of matrimonial assets pending divorce proceedings.
